These terms apply to the use of evavanderklei.nl and explain the general basis on which Eva discusses and delivers creative projects. A project-specific written quotation or agreement may contain additional terms and will take priority if it conflicts with this page.
About these terms
The website and services are provided by Eva van der Klei, an independent mural artist based in the Netherlands and registered with the Dutch Chamber of Commerce under number 95002510.
By using this website, you agree to use it lawfully and in accordance with these terms. If you commission work, the project-specific quotation, brief and written communications form part of the agreement.
Website use
You may view and share links to publicly available pages for normal personal or business reference. You may not interfere with the website, attempt unauthorised access, scrape it in a way that disrupts the service, or reuse its content in a misleading or unlawful way.
External websites and social platforms are governed by their own terms. Eva is not responsible for the availability, content or practices of third-party services.
Estimates & agreements
Any price range shown by the online estimator is an initial indication only. It is not a binding offer. Final pricing depends on factors such as dimensions, design detail, wall condition, preparation, access equipment, materials, location, travel, scheduling and weather exposure.
A binding project agreement is formed only after the scope, price and relevant conditions have been confirmed in writing and accepted by both parties. Unless the written quotation says otherwise, prices, deposits, invoicing stages, taxes and payment deadlines are set out in that quotation or invoice.
Client responsibilities
Unless otherwise agreed in writing, the client is responsible for:
- providing accurate information about the wall, site, dimensions, surface and access;
- having the owner’s permission and obtaining any required municipal, landlord or other approvals;
- providing safe, timely access to the work area and any agreed electricity or water facilities;
- informing Eva about hazards, restricted access, fragile surfaces or other relevant site conditions;
- ensuring that supplied text, logos, photographs and other materials may legally be used.
Unexpected site conditions may require a revised method, schedule or price. Eva will discuss material changes before carrying out additional work where reasonably possible.
Creative process
The creative direction is developed from the accepted brief. Sketches, colour studies, mock-ups, revision stages and approval moments are included only to the extent stated in the written quotation or project agreement.
The client must review submissions carefully and provide consolidated feedback within the agreed timeframe. Changes requested after approval, changes outside the agreed brief or additional revision rounds may affect the fee and completion date.
Minor differences between a digital concept and a finished hand-painted work are part of the nature of mural painting, materials, surface texture, lighting and scale.
Scheduling & cancellation
Dates are planned in good faith but may depend on timely feedback, site readiness, weather, access, permits, material availability, health and other circumstances. Outdoor work may be paused or rescheduled when conditions could affect safety or quality.
Cancellation, rescheduling and deposit terms stated in the accepted quotation apply. If no specific cancellation arrangement was agreed, the client remains responsible for work already performed and reasonable non-recoverable costs or commitments made for the project, subject to mandatory consumer law.
Neither party is responsible for delay caused by events reasonably outside its control. The parties will try to agree a practical new schedule or solution.
Copyright & publicity
Unless expressly transferred in writing, Eva retains copyright and other intellectual property rights in concepts, sketches, designs, photographs and finished artwork. Paying for a mural does not automatically transfer copyright in the design.
The client receives the usage rights expressly described in the project agreement. The client may not reproduce, adapt, merchandise, license or commercially exploit the artwork beyond those rights without written permission.
Unless confidentiality or different publicity terms are agreed before the project, Eva may photograph and film the process and completed work and use that material for her portfolio, website, social media, press and self-promotion. The client should identify any location, person, trademark or confidentiality restrictions before work begins.
Quality, maintenance & liability
Eva will perform agreed services with reasonable professional care. The lifespan and appearance of a mural can be affected by the wall condition, moisture, structural movement, sunlight, pollution, cleaning, vandalism, later building work and weather. Any specific warranty or maintenance arrangement must be stated in writing.
To the extent permitted by law, Eva is not responsible for indirect or consequential loss, third-party platform outages, inaccurate information supplied by the client, hidden wall defects or changes made to the work without her approval. Nothing in these terms excludes or limits liability where doing so would be unlawful, including mandatory consumer rights.
Privacy & changes
Personal data is handled as described in the Privacy Policy. These terms may be updated to reflect changes to the website, services or applicable rules. The version published when a project is agreed does not replace any different terms already accepted for that project.
Governing law & contact
These terms and the use of the website are governed by Dutch law. Any dispute will be submitted to the competent court in the Netherlands, without affecting any mandatory rights a consumer may have to bring a claim elsewhere or use another legally available procedure.
